Company or RGJ – SIA RGJ, registration number 40003688115, legal address: Krustpils iela 141B, Riga, LV-1057, Latvia.

Website – the website www.rgj.lv, owned and operated by the Company.

User – any natural or legal person who visits and uses the Website.

Client – a natural or legal person who uses the Website to view products and submit consultation requests or other inquiries to the Company.

Products – stainless steel chimneys, chimney liners, chimney pipes and related products offered on the Website.

Services – consultations, product customization, installation guidelines and other services offered by the Company.

Content – all texts, images, videos, graphics, logos, product descriptions and other materials published on the Website.

Terms – these terms and conditions.

1.2. Application of the Terms

1.2.1. These Terms govern the use of the Website and define the legal relationship between the User/Client and the Company.

1.2.2. By using the Website, you confirm that you have read, understood and agree to these Terms without any reservations.

1.2.3. If you do not agree to these Terms or any part thereof, please do not use the Website.

1.2.4. These Terms form an integral part of any contract or agreement entered into between the Client and the Company.

1.3.1. The Company reserves the right to amend or supplement these Terms at any time without prior notice.

1.3.2. All amendments take effect from the moment they are published on the Website.

1.3.3. By continuing to use the Website after amendments are published, you agree to the amended Terms.

2. USE OF THE WEBSITE

2.1. Purpose and functionality of the Website

2.1.1. The Website is an informative catalog demonstrating the Company's products and services.

2.1.2. The Website is NOT an e-commerce platform. Products cannot be purchased directly on the Website, and online payment functionality is not available.

2.1.3. All purchases and orders are made through consultation forms, email or telephone.

2.1.4. Main functions of the Website:

Product catalog and descriptions
Viewing product specifications and technical parameters
Submitting consultation requests
Viewing installation guidelines and manuals
Access to contact information
Viewing certificates and declarations

2.2. User obligations

2.2.1. The User undertakes to:

Use the Website only for lawful purposes;
Provide true and accurate information when submitting consultation forms;
Not perform actions that could harm the operation or security of the Website;
Comply with all applicable laws of the Republic of Latvia;
Not attempt to gain unauthorized access to the Website's systems;

3. CONSULTATIONS AND REQUESTS

3.1. Consultation requests

3.1.1. Clients may submit consultation requests using the forms available on the Website, by email (rgj@rgj.lv) or by phone (+371 67702280).

3.1.2. When submitting a consultation request, the Client undertakes to provide true and accurate information.

3.1.3. The Company processes consultation requests on working days from 09:00 to 17:00.

3.1.4. The Company strives to respond to requests within 1-3 working days, however the specific response time may vary depending on the complexity of the request.

3.2. Individual offers

3.2.1. After receiving a consultation request, the Company may prepare an individual offer with product specifications and price.

3.2.2. All offers are informative and are not considered a binding contract unless explicitly stated otherwise.

3.2.3. Offers are valid for the period specified in the offer or, if no period is specified, 30 calendar days from the date of issue.

3.2.4. The Company reserves the right to refuse to issue an offer or to modify the terms of the offer without justification.

3.3. Order fulfillment

3.3.1. Orders are accepted only after written agreement between the Client and the Company.

3.3.2. Order fulfillment time, delivery terms, price and payment procedure are agreed individually in each specific case.

3.3.3. The final contract terms are reflected in a separate agreement or order confirmation.

4. PRICES AND PAYMENTS

4.1. Price information

4.1.1. Prices indicated on the Website (if any) are informative and may change without prior notice.

4.1.2. Final prices are agreed individually and indicated in the offer or order confirmation.

4.1.3. All prices are indicated in EUR (euros) and include VAT (unless otherwise stated).

4.2. Payment procedure

4.2.1. Payment procedure, terms and deadlines are determined individually in each contract.

4.2.2. The Company accepts payments by:

Bank transfer
Cash (upon receipt of goods at the company)
Other methods agreed with the Client

4.2.3. The Client is obliged to make payments in accordance with the procedure and deadlines specified in the contract.

5. PRODUCTS AND THEIR DESCRIPTIONS

5.1. Product information

5.1.1. The Company strives to ensure that the information about products published on the Website is accurate, complete and up-to-date.

5.1.2. However, the Company does not guarantee that:

All information is completely accurate and error-free;
Products will be available at all times;
Product images accurately reflect the actual appearance of the product (colors may vary depending on screen settings).

5.1.3. Product specifications, dimensions, colors and other parameters may be changed without prior notice.

5.1.4. The Company is not responsible for errors or inaccuracies in the Website content, unless they resulted from malicious action.

5.2. Product availability

5.2.1. The availability of all products is clarified by contacting the Company.

5.2.2. The Company reserves the right to discontinue the production or sale of any product at any time without prior notice.

5.3. Customization

5.3.1. The Company offers product customization (dimensions, color, material) according to the Client's needs.

5.3.2. Customization options and conditions are agreed with the Company for each order separately.

5.3.3. Customized products may not be returnable or exchangeable.

6. DELIVERY

6.1. Delivery terms, costs and deadlines are agreed individually in each contract.

6.2. Delivery is made to the address specified by the Client in Latvia or other countries (by agreement).

6.3. The Company is not responsible for delays caused by force majeure circumstances.

6.4. The risk of damage or loss of goods passes to the Client at the moment when the goods are handed over to the carrier or to the Client.

7. WARRANTIES AND LIABILITY

7.1. Product warranty

7.1.1. The Company guarantees that the products comply with:

Applicable Latvian and EU standards;
Specifications specified in the contract;
Certification requirements.

7.1.2. The warranty period and conditions are determined individually in each contract.

7.1.3. The warranty does not cover:

Damage caused by improper installation;
Damage resulting from improper use;
Natural wear and tear;
Mechanical damage after the product has been handed over to the Client.

7.2. Limitation of liability

7.2.1. The Company is not responsible for:

Errors or inaccuracies in the Website content, except in cases where they resulted from intentional action;
Any losses resulting from the use of the Website or the inability to use it;
The content of third-party websites linked from the Website;
Computer viruses or other harmful elements that could infect the User's device;
Data loss or damage to the User's device.

7.2.2. The maximum liability of the Company arising from these Terms shall not exceed the amount paid by the Client to the Company in the relevant transaction.

7.2.3. The Company is in no circumstances liable for indirect, incidental, special or consequential damages.

8. INTELLECTUAL PROPERTY

8.1. Copyright

8.1.1. All Website Content (texts, images, videos, logos, design, graphics, code, etc.) is the property of the Company or its licensors and is protected by copyright law.

8.1.2. The User is prohibited from:

Reproducing, copying, distributing or modifying the Content without written permission;
Using the Content for commercial purposes;
Removing or altering copyright notices or other proprietary rights markings.

8.2. Permitted use

8.2.1. The User may:

View and download Content for personal, non-commercial purposes;
Print individual pages for informational purposes.

8.3. Trademarks

8.3.1. The RGJ name, logo and other trademarks are registered or unregistered trademarks of the Company.

8.3.2. The User has no right to use these trademarks without the Company's written consent.

9.1. Personal data processing is carried out in accordance with the Company's Privacy Policy, which is available on the Website.

9.2. By submitting consultation forms or otherwise providing personal data, the User confirms that they have read and agree to the Privacy Policy.

9.3. The Company undertakes to protect Users' personal data in accordance with GDPR and other applicable legislation.

12. FORCE MAJEURE

12.1. The Company is not responsible for non-performance or improper performance of obligations if it is the result of force majeure circumstances.

12.2. Force majeure circumstances include, but are not limited to:

Natural disasters (earthquakes, floods, fires);
Warfare, terrorist acts, civil unrest;
Government action, changes in laws or regulations;
Strikes, blockades;
Power supply interruptions;
Pandemics, epidemics;
Other circumstances beyond the Company's control.

12.3. If force majeure circumstances continue for more than 90 days, either party may terminate the contract.

13. DISPUTE RESOLUTION

13.1. Applicable law

13.1.1. These Terms and all related relationships are governed by the laws of the Republic of Latvia.

13.2. Dispute resolution

13.2.1. All disputes arising from or related to these Terms shall first be resolved through negotiation.

13.2.2. If the dispute cannot be resolved through negotiation within 30 days, the dispute shall be submitted for resolution to the courts of the Republic of Latvia in accordance with Latvian legislation.

13.2.3. Consumers have the right to contact the Consumer Rights Protection Centre (www.ptac.gov.lv) or the European Consumer Dispute Resolution Platform (ec.europa.eu/consumers/odr).

14. ENTRY INTO FORCE AND VALIDITY OF THE TERMS

14.1. These Terms enter into force from the moment they are published on the Website.

14.2. The Terms are valid indefinitely until they are revoked or replaced with new terms.

14.3. If any provision of the Terms is deemed invalid or unenforceable, the remaining provisions remain in force.

16. FINAL PROVISIONS

16.1. These Terms together with the Privacy Policy and other terms published on the Website constitute the complete agreement between the User and the Company regarding the use of the Website.

16.2. The Company's failure to enforce any of these Terms shall not be deemed a waiver of the right to enforce these terms in the future.

16.3. These Terms are available in English. In case of dispute, the English language version shall prevail.
